Terms of Service & Bidder Agreement

1. Acceptance of These Terms

These Terms of Service and Bidder Agreement (the “Terms”) govern your use of the Timeless Wheels website, marketplace, and auction platform (the “Platform”). By creating an account, browsing, or placing a bid, you agree to these Terms. If you do not agree, do not use the Platform.

2. Accounts & Eligibility

You must be at least 18 years old and able to enter a binding contract to register. You agree to provide accurate account information and to keep it current. You are responsible for activity under your account and for keeping your password confidential.

Before bidding, you must verify your email address and place a valid payment card on file. We may decline, suspend, or revoke bidding privileges at our discretion, including for non-payment or suspected fraud.

3. Bids Are Binding Offers

Every bid you place is a binding offer to purchase the vehicle at the bid amount. Bids cannot be retracted. If you are the high bidder when an auction closes and any reserve has been met, you have entered a binding purchase contract with the seller and are obligated to complete the transaction.

Bid manipulation of any kind — including shill bidding, bidding in coordination with a seller, or interfering with the bidding of others — is prohibited and grounds for immediate account termination and forfeiture of any deposit.

4. Buyer's Premium, Deposits & Fees

A buyer's premium of 5% of the winning bid, capped at $5,000, applies to each vehicle purchased at auction. The buyer's premium is charged to the payment card on file at the close of the auction.

Certain auctions may require a refundable bidding deposit, which will be disclosed on the listing before you bid. Deposits are returned promptly to unsuccessful bidders and credited toward the purchase for winning bidders. A winning bidder who fails to complete the purchase forfeits the deposit, in addition to any other remedies available to us or the seller.

5. Payment & Completing Your Purchase

The vehicle purchase price is paid directly per the instructions in your winning-bid confirmation, typically by wire transfer or ACH. Payment in full is due within the window stated on the listing or confirmation. Title transfer and delivery arrangements begin once payment clears.

Wire fraud warning

Wire fraud is real and unrecoverable. Before sending any wire, verify the payment instructions by phone using the number published on our website — never a number or account detail from an email alone. We will never change wire instructions by email. If you receive “updated” instructions, stop and call us first.

6. Vehicle Condition — Sold As-Is

Every vehicle is sold as-is, where-is, with all faults and without warranty of any kind, express or implied, including merchantability or fitness for a particular purpose. Classic and collector vehicles are decades old; descriptions, photographs, and condition notes are provided in good faith but are not a substitute for your own judgment.

We strongly encourage in-person inspection or a third-party pre-purchase inspection before bidding. We are happy to accommodate inspections at our showroom — plan a visit or contact us to arrange one.

7. Disputes & Concerns After Sale

If you believe a vehicle was materially misdescribed, you must notify us in writing within 7 calendar days of taking delivery (or pickup), and before the vehicle is modified, registered for competition, or driven beyond reasonable delivery mileage. We will review documented claims in good faith and work with both parties toward a resolution. Claims raised outside this window are waived to the fullest extent permitted by law.

8. Sellers & Listings

Sellers represent that they hold (or can deliver) clear title, that listing information they provide is accurate to the best of their knowledge, and that the vehicle is available for sale. Sellers may not bid on their own vehicles or arrange for others to do so.

9. Prohibited Conduct

You agree not to: circumvent the Platform to complete a sale initiated here; scrape or harvest data; interfere with the operation or security of the Platform; misrepresent your identity; or use the Platform for any unlawful purpose.

10. Limitation of Liability

To the fullest extent permitted by law, Timeless Wheels is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform or any transaction conducted through it. Our total liability for any claim will not exceed the fees you paid to us in connection with the transaction giving rise to the claim.

11. Governing Law & Changes

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be posted on this page with an updated date, and continued use of the Platform after a change constitutes acceptance.
